By accessing or using ReelStick ("Service"), operated by ReelStick ("Company," "we," "us," or "our") at reelstick.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Service. These Terms constitute a legally binding agreement between you and ReelStick.

2. Description of Service

ReelStick is an AI-powered video creation platform that enables users to generate short-form stick figure animation videos. The Service includes AI script generation, AI image generation, AI voiceover synthesis, and video rendering and download capabilities. All content is generated using artificial intelligence and may not always produce perfect or predictable results.

3. Eligibility

You must be at least 18 years of age to use ReelStick. By using the Service, you represent and warrant that you are 18 or older, have the legal capacity to enter into binding contracts, and are not prohibited from using the Service under applicable law. If you are using ReelStick on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

4. Account Registration

To access the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials
• Promptly notify us of any unauthorized access to your account
• Accept responsibility for all activity occurring under your account
• Not share your account with any third party

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

5. Subscription Plans and Billing

ReelStick offers the following subscription plans:

By subscribing, you agree to the following billing terms:

• Subscriptions are billed monthly in advance on your billing date
• Payment is processed securely through Stripe
• Subscriptions automatically renew unless cancelled before the renewal date
• Video credits reset monthly and do not roll over to the following month
• Unused credits expire at the end of each billing cycle
• We reserve the right to modify pricing with 30 days written notice
• All prices are in US Dollars and exclude applicable taxes

6. Acceptable Use Policy

You agree not to use ReelStick to generate, create, or distribute content that:

• Is illegal, defamatory, fraudulent, or deceptive
• Infringes intellectual property rights of third parties
• Contains hate speech, discrimination, or content targeting protected characteristics
• Depicts or promotes violence, self-harm, or dangerous activities
• Is sexually explicit or pornographic
• Harasses, stalks, or threatens any individual
• Impersonates real persons, brands, or organizations without authorization
• Promotes illegal products, substances, or activities
• Attempts to circumvent platform limitations or abuse the credit system
• Is generated for the purpose of spam, phishing, or misinformation campaigns

Violation of this Acceptable Use Policy may result in immediate account termination without refund.

We strive to maintain high service availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to scheduled maintenance, technical issues, or factors beyond our control including third-party provider outages. We are not liable for any losses arising from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

• ReelStick is provided on an "as is" and "as available" basis without warranties of any kind
• We expressly disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
• ReelStick shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the three months preceding the claim
• We are not responsible for the actions of third-party service providers including OpenAI, ElevenLabs, Anthropic, and others
• We are not liable for any damages arising from AI-generated content that does not meet your expectations

11. Indemnification

You agree to defend, indemnify, and hold harmless ReelStick and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of third-party rights through your use of generated content.

12. Cancellation and Termination

You may cancel your subscription at any time through your account settings. Upon cancellation:

• You will retain access to the Service until the end of your current billing period
• No partial refunds will be issued for the remaining days of a billing period
• Unused video credits will expire at the end of the billing period

We reserve the right to suspend or terminate your account immediately without notice if you violate these Terms, engage in fraudulent activity, or abuse the Service.

13. Governing Law and Disputes

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, rather than in court, except that either party may seek injunctive relief in court for intellectual property infringement.

14. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by email or platform notification at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
